Terms of Service

1. Acceptance of Terms

By accessing or using XVHost services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all terms, you may not access or use our Services.

2. Eligibility

You must be at least 18 years of age to use our Services. By agreeing to these Terms you represent that you are at least 18 years old and have legal authority to enter into this agreement.

3. Account Registration

You must provide accurate, complete, and current information during registration. You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately at support@xvhost.com of any unauthorised account access.

4. Service Plans and Payment

• Services are provided on a subscription basis, billed monthly or annually as selected.
• All fees are payable in advance and are non-refundable except as stated in our Refund Policy.
• We offer a 30-day money-back guarantee on shared hosting plans for new customers.
• Late payments may result in service suspension after 7 days' notice.
• Prices are subject to change with 30 days' notice to existing customers.

5. Acceptable Use Policy

You agree not to use our Services to:

• Host, distribute, or transmit illegal content of any kind
• Send unsolicited bulk email (spam) or operate mailing lists without confirmed opt-in
• Conduct phishing, fraud, or identity theft activities
• Host cryptocurrency mining software or scripts
• Distribute malware, ransomware, spyware, or other malicious code
• Conduct or facilitate DDoS attacks against any third party
• Use excessive server resources that negatively impact other customers
• Violate any applicable local, national, or international law

Violations may result in immediate account suspension without refund.

6. Uptime Service Level Agreement

XVHost guarantees 99.9% network uptime for all shared hosting plans, measured monthly. Excluded from this SLA: scheduled maintenance windows (announced 48 hours in advance), customer-caused outages, force majeure events, and DNS propagation delays. If uptime falls below 99.9% in any calendar month, eligible customers may request a pro-rata credit.

7. Backups

XVHost performs daily backups as a courtesy service. We strongly recommend maintaining your own independent backups. Backup availability is not guaranteed and we accept no liability for data loss. Restore requests may incur a service fee on plans without included restoration.

8. Intellectual Property

You retain all rights to content you upload to our servers. By using our Services, you grant XVHost a limited licence to store, transmit, and display your content solely as required to provide the Services. XVHost's trademarks and brand assets may not be used without written permission.

9. Limitation of Liability

To the maximum extent permitted by law, XVHost's total liability for any claim shall not exceed the amount paid by you in the 3 months preceding the claim. We shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of profits, data, or business opportunities.

10. Termination

You may cancel your account at any time via the Client Portal. XVHost reserves the right to suspend or terminate accounts that violate these Terms. Upon termination, your data will be deleted within 30 days.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to Terms

We may update these Terms at any time. We will notify active customers via email at least 30 days before material changes take effect. Continued use after the effective date constitutes acceptance.
